You follow the rules of the road. You have liability insurance as required by law. You might even think you have "full coverage." But if you were seriously injured by another driver today, would your policy actually protect you from financial disaster?
For many drivers in North Carolina, the answer is a startling "No."
At Bill Layne Insurance in Elkin, we see it constantly: responsible drivers facing massive medical bills because their policy lacked protection against the most common threat: the driver with little or no insurance. We're talking about Uninsured (UM) and Underinsured Motorist (UIM) coverage.
The Big Change: New NC Laws in 2025
As of July 1, 2025, North Carolina implemented significant changes to auto insurance requirements. This was a necessary step, as the previous limits hadn't been updated in decades.
New NC Minimum Limits (Effective July 1, 2025):
- $50,000 Bodily Injury Liability per person
- $100,000 Bodily Injury Liability per accident
- $50,000 Property Damage Liability
Additionally, Underinsured Motorist (UIM) coverage is now mandatory on all policies.
While this is an improvement, it has created a dangerous misconception: Just because the limits increased doesn't mean they are enough to protect you. Furthermore, estimates suggest roughly 10% of drivers in NC still operate with no insurance at all.
The "Minimum Limit" Trap
Let's look at the real costs of an accident in 2025. The average transaction price for a new vehicle is now around $48,500. Medically, the costs are even more alarming. The average inpatient hospitalization following a motor vehicle crash is around $57,000, and serious injuries can easily exceed $100,000.
Now, imagine you are hit by a driver who is 100% at fault, but they only carry the NC state minimum limits.
The Financial Gap Scenario
Your Damages:
- Your new SUV is totaled: $55,000
- Your medical bills (surgery and recovery): $90,000
The At-Fault Driver's Insurance Pays (Max Limits):
- Property Damage Limit: $50,000
- Bodily Injury Limit: $50,000
The Result:
You are left with a $5,000 deficit on your car and $40,000 in unpaid medical bills. That’s $45,000 out of your pocket for an accident you didn't cause—unless you have adequate UM/UIM coverage.
UM/UIM: The Coverage That Protects YOU
UM/UIM is designed specifically to fill the gap when the at-fault driver’s insurance is insufficient or nonexistent.
Uninsured Motorist (UM)
Covers your damages if you are hit by a driver with absolutely no insurance, or in the case of a hit-and-run accident.
Underinsured Motorist (UIM)
Covers the difference when the at-fault driver has insurance, but their limits are too low to cover the full extent of your damages.
The Game Changer: "Stacking" Coverage in NC
Another critical aspect of the July 2025 law change involves how UIM is paid out. Previously, North Carolina allowed a "setoff" or "credit rule," meaning your UIM coverage amount was reduced by the amount the at-fault driver’s insurance paid.
The new law eliminates this setoff. Your UIM coverage now "stacks" on top of the at-fault driver's liability coverage.
Why Stacking Matters:
If the at-fault driver has $50k liability and you have $100k UIM, you now have access to a total of $150k in coverage ($50k from them + $100k from your UIM). This significantly increases the value of carrying high UIM limits.
The Golden Rule: How Much UM/UIM Do You Need?
The simple answer: As much as you can reasonably afford.
"We strongly recommend that your UM/UIM limits match your primary liability limits."
If you carry 250/500/100 liability to protect your assets (like your home and savings) in case *you* cause an accident, you need 250/500/100 UM/UIM to protect yourself if someone else causes one. Why protect a stranger more than you protect your own family?
The Cost is Minimal, The Protection is Massive
Many drivers are surprised to learn how affordable it is to increase UM/UIM coverage. While liability coverage is often the most expensive part of your policy, increasing your UM/UIM limits usually results in a relatively small premium increase. It is arguably the best value in auto insurance.
Don't Gamble on Other Drivers. Take Control.
You can't control what insurance others carry, but you can control how well you are protected. Don't wait until you have a claim to discover your coverage is inadequate in the face of rising costs.
