Under North Carolina law (G.S. 20-71.4), a vehicle is generally considered a total loss when repair costs reach or exceed 75% of its fair market / Actual Cash Value (ACV). Claims questions, explained

A few common questions.

What if the other driver does not have insurance?

Notify your carrier and ask it to review any uninsured motorist coverage that applies to your situation. Available coverage, limits and deductibles depend on your policy and the facts of the loss.

Should I accept the first settlement offer?

Ask the adjuster for a written explanation and compare it with your damage records and estimates. Discuss missing items or disagreements before accepting. Get legal advice if you have questions about signing a release or resolving an injury claim.

Will filing a claim affect my insurance rate?

It depends on fault, claim history and underwriting rules. North Carolina does not allow insurance points for an accident that was not your fault, but other underwriting factors can still affect your policy. Ask us or your carrier to review your situation.

What is a Prayer for Judgment Continued (PJC) in NC?

A PJC is a court disposition. Its insurance effect depends on the offense, household driving history and the rules applicable to the conviction date. NC rules changed for convictions on or after July 1, 2025. Review the current NC Department of Insurance guidance and speak with an attorney about your case.

How long do I have to file a claim?

Notify your carrier promptly and follow your policy’s reporting requirements. A policy reporting deadline and the deadline for a lawsuit are different. Legal deadlines vary by claim and circumstances; ask an attorney about deadlines that may apply to you.

Does my insurance cover a rental car during repairs?

Rental reimbursement under your own policy generally requires the applicable coverage and is subject to limits and conditions. Ask the carrier about authorization, daily limits and duration before renting. A rental requested from another driver’s insurer is subject to its investigation and liability decision.

What is diminished value?

Diminished value refers to a possible reduction in a vehicle’s market value after damage and repair. Eligibility and the amount depend on the circumstances, evidence and applicable law. Ask the adjuster what documentation is needed; an attorney can advise you on your rights.

What should I do after storm damage to my home?

Prioritize safety, document damage and notify your carrier promptly. If safe, take reasonable temporary steps to prevent further damage and keep receipts. Ask the adjuster about inspections, damaged items and permanent repairs. Storm volume and the extent of damage can affect timing.
